Wi-Fi Consumer - Terms of Use

ARTICLE 1 - PURPOSE

The purpose of this document is to define the terms of use of the Internet service for Wi-Fi connection within areas covered by the STRICS ADS SA network (hereinafter the “Service” or “Relead”). This service allows the visitor of the covered area (hereinafter the “Visitor” or the “User”) to use the Wi-Fi service made available free of charge by the service provider (hereinafter the “Service”) to connect wirelessly and at high speed to the Internet within the covered areas.

The Relead service does not include the provision of email mailboxes or web page hosting.

The Relead Internet service allows the user to connect to the Internet, communicate via an email system, and download files without limitation regarding the volume of data exchanged.

When you use Wi-Fi, Relead collects and processes your personal data in accordance with the provisions of Organic Law No. 63 dated 27 July 2004 on the protection of personal data. Please refer to our Privacy Policy.

ARTICLE 2 - ACCESS TO RELEAD INTERNET SERVICE

2.1. The visitor to the covered area is required to adhere to the following conditions:
  • Access to the Internet via Wi-Fi is available free of charge to users and is only possible from each private location offering Internet access to its customers, which is, on the one hand, equipped with the Relead system and, on the other hand, has access to the Internet provided by a public telecommunications network operator. The public telecommunications network operator provides electronic communication services and Internet access that you use as a user. Furthermore, its use is subject to the terms and conditions set forth herein.
  • The Service reserves the right to adapt or amend these Terms of Use at any time. The Visitor is therefore encouraged to regularly review les politiques de confidentialité to stay informed of the latest developments.
  • To use the Service, the Visitor must first register on the Relead home page accessible from a device (mobile phone, computer, tablet, etc.) only within the area covered by the service. To do so, the Visitor must, once on the Service’s homepage, complete the requested information, accept these Terms of Use by ticking the appropriate box, and validate their registration. The Visitor undertakes to provide accurate information.
  • ARTICLE 3 - VISITOR'S COMMITMENT

    3.1. The Visitor undertakes, when in the covered area, not to use the Service to transmit, record, broadcast, and/or reproduce, on any medium and by any means, in whole or in part, sounds, images, or content protected by intellectual property rights, including but not limited to descriptions, results, photographs, and videos related to any events taking place in the same space. In general, the Visitor is prohibited from sending, transmitting, or receiving via the Service, by any means whatsoever, any data or content that is prohibited, unlawful, illegal, contrary to public decency or public order, including but not limited to, content that is pedophilic, pornographic, incites racial hatred, or the commission of xenophobic crimes and offenses, or infringes image rights and privacy, or more generally the rights of third parties. The Visitor undertakes to strictly comply with these provisions and shall indemnify the owner of the premises against all claims or legal action in this respect. Failure to comply will make the Visitor liable for all consequences of such violations, including damages and compensation. 3.2. The Visitor undertakes to use the Service in accordance with proper Internet conduct. They must not engage in fraudulent, abusive, or excessive use of the Service, such as, but not limited to:
  • Voluntarily or involuntarily overloading messaging servers and/or email recipients with mass mailing (spamming) or network congestion.
  • Sending attractive messages that generate an excessive number of responses, potentially disrupting the availability of servers or networks.
  • Making available, downloading, viewing, sharing, or otherwise communicating works protected by third-party intellectual property rights, including via so-called “peer-to-peer” software or streaming.
  • Hacking in any form, intruding into computer or audiovisual systems, distributing viruses, trojans, or other harmful programs.
  • 3.3. In this respect, the Visitor acknowledges being fully aware that:
  • The Internet network is unreliable, particularly in terms of the security of data transmissions and the lack of guaranteed performance regarding data volume and transmission speed.
  • The integrity, authentication, and confidentiality of information, files, and data of any kind they wish to exchange over the Internet cannot be guaranteed. The user must therefore not send via the Internet any messages whose confidentiality they wish to be guaranteed without fail.
  • The user of the Internet service is solely responsible for any direct or indirect, material or immaterial damage caused to third parties as a result of their use.

    ARTICLE 4 – SERVICE COMMITMENTS AND LIABILITY

    4.1. The Service shall make every effort to ensure access to the service but cannot guarantee speed, which depends in particular on the number of users connected simultaneously. The Service strives to operate and maintain access to the Service but is under no obligation to achieve a specific result. The Visitor is informed that the Service reserves the right to suspend access at its discretion, particularly for maintenance or in case of hacking, without the Visitor being able to make any claim in this regard. The Service may also limit the duration or bandwidth of Internet connections per day and per device (mobile phone, computer, tablet, etc.).
    4.2. The Service is not responsible for content accessible via the Internet network. It is not liable for any bodily, material, or immaterial harm, whether consequential or not, caused to the Visitor as a result of using the Service. An exception to the confidentiality rule may be made within the limits allowed by the law, at the request of public and/or judicial authorities. To learn more about our personal data usage policy, please refer to our  Privacy Policy.
    4.3. The Service cannot be held responsible for the use of data and information introduced by the user into the Internet network. It declines all liability for the consequences of fraudulent, abusive, or excessive use of the service.
    4.4. The Service’s liability cannot be engaged towards the user:
  • In case of misuse of the service.
  • In case of incorrect installation and/or incorrect configuration and/or malfunction of connection equipment.
  • In case of non-compliance with obligations.
  • In case of inability to access a company's virtual private network via the Internet.
  • In case of disruptions or interruptions.
  • In case of disruptions and/or total or partial unavailability, and/or interruption of all or part of the services offered on networks operated by Third-Party Operators.
  • ARTICLE 5 – ADVERTISING

    The Relead service is free for visitors as clients of a site equipped with the Relead system. In return, visitors agree to receive any advertising message, sales promotion, quiz, game, or other commercial messages. As a user of the service, you acknowledge and accept that Relead may broadcast third-party advertisements before each connection to its Wi-Fi network.

    ARTICLE 6 – SUSPENSION OR TERMINATION

    The Service, at the request of third parties and/or any competent authority, reserves the right to suspend the Wi-Fi service temporarily or permanently without incurring any liability and without the user being entitled to claim any compensation or damages.

    ARTICLE 7 – ACCEPTANCE

    Registration to the Service’s Internet access for the purpose of obtaining an access code constitutes acceptance of these Terms of Use.

    ARTICLE 8 – GOVERNING LAW

    These Terms of Use are governed by Tunisian law. The validity and/or enforcement of these Terms of Use shall be subject to the competent courts of Sousse.
