Terms and Conditions of Use

ARTICLE 1 - PURPOSE

The purpose of this document is to define the conditions of use of the Internet service for connection to the Internet by Wi-Fi from areas covered by the STRICS ADS SARL network called “Service” or “Relead”. This service allows the user visiting the covered area (hereinafter “the Visitor” or “the user”) using the Wi-Fi service made available free of charge by the owner of the service (hereinafter “the Service”). ") to connect to wireless, high-speed Internet from areas covered by the Internet network.

The Relead service does not include the provision of mailboxes or the hosting of WEB pages.

The Internet service of Relead allows the user to connect to the Internet, communicate via an electronic messaging system and download files without limitation on the volume of data exchanged.

ARTICLE 2 - ACCESS TO RELEAD INTERNET SERVICE

2.1. The visitor to the covered area is required to adhere to the following conditions:

Access to the Internet via Wi-Fi is available free of charge to users and is only possible from each private location offering Internet access to its customers, which is, on the one hand, equipped with the Relead system and, on the other hand, has access to the Internet provided by a public telecommunications network operator. The public telecommunications network operator provides electronic communication services and Internet access that you use as a user. Furthermore, its use is subject to the terms and conditions set forth herein.

To benefit from the Service, the Visitor must first register on the Relead homepage, which is accessible from a device (mobile phone, computer, tablet...) only within the covered area of the service. To do this, the Visitor must, once on the Service's homepage, complete the requested information, accept these Terms of Use by checking the corresponding box, and then confirm their registration for the service. The Visitor undertakes to provide accurate information.

ARTICLE 3 - VISITOR'S COMMITMENT

3.1. The Visitor commits, during their visit to the covered area, not to use the Service to transmit, record, broadcast, and/or reproduce, on any media and by any means, in whole or in part, sounds, images, or content protected by intellectual property rights, including but not limited to, descriptions, results, photographs, videos related to any events taking place in the same area. In general, the Visitor is prohibited from sending, transmitting, and receiving through the Service, by any means, any data or content that is prohibited, illegal, contrary to public morals or public order, including but not limited to, content of a pedophilic or pornographic nature, content that incites racial hatred or the commission of xenophobic crimes and offenses, or content that infringes on the right to image and the respect for the privacy of others, or, more generally, the rights of third parties. The Visitor undertakes to strictly adhere to these stipulations and guarantees the owner of the space against all claims and actions in this regard. In the absence of compliance, the Visitor will be liable for all consequences of the violation of these stipulations, including damages and compensation. 3.2. The Visitor commits to using the Service in accordance with good internet conduct rules. The Visitor specifically refrains from any fraudulent, abusive, or excessive use of the Service, including but not limited to:

The intentional or unintentional congestion of mail servers and/or email recipients through mass mailing (such as spamming) or the network.

Sending enticing messages that necessarily generate a significant number of responses, which can disrupt the availability of servers or networks.

The provision, downloading, viewing, sharing, exchange, or communication in any way, including through peer-to-peer software or streaming, of works protected by the intellectual property rights of third parties.

Hacking in any form, intrusion into computer or audiovisual systems, spreading viruses, Trojans, or other programs intended to cause harm in any form.

3.3. In this respect, the Visitor acknowledges being fully informed:

Of the unreliability of the Internet network, especially in terms of the lack of data transmission security and the absence of guarantees regarding data transmission volume and speed.

That the integrity, authentication, and confidentiality of the information, files, and data of any kind that the Visitor wishes to exchange on the Internet network cannot be guaranteed. The Visitor should not transmit messages via the Internet network for which they would require absolute confidentiality to be guaranteed.

The user of the Internet service is solely responsible for any direct or indirect, tangible or intangible harm caused to third parties due to their usage.

ARTICLE 4 - COMMITMENTS AND RESPONSIBILITIES OF THE SERVICE

4.1. The "Service" makes every effort to provide access to the service, even though it cannot guarantee the speed, which depends on factors such as the number of users connected simultaneously. It strives to operate and maintain the Service, but it is not bound by any obligation to achieve specific results. The Visitor is informed that the "Service" reserves the right to suspend access to the Service at its discretion, especially for maintenance or security reasons, without the Visitor being able to raise any claims or objections in this regard. Furthermore, the "Service" reserves the possibility of limiting the duration or speed of internet connection via the Service per day and per device (mobile phone, computer, tablet...).
4.2. The "Service" is not responsible for the content accessible through the Internet network. The "Service" is not responsible for any physical, material, or immaterial damages, whether consequential or not, caused to the Visitor due to their use of the Service. An exception to the confidentiality rule may be made within the limits allowed by the law, at the request of public and/or judicial authorities. 4.3. The "Service" cannot be held responsible for the use of data and information introduced by the user of the service on the Internet network. The Service disclaims all responsibility for the consequences of fraudulent, abusive, or excessive use of the service.
4.4. The responsibility of the "Service" cannot be invoked against the user:

In case of misuse of the service.

In case of incorrect installation and/or incorrect configuration and/or malfunction of connection equipment.

In case of non-compliance with obligations.

In case of inability to access a company's virtual private network via the Internet.

In case of disruptions or interruptions.

In case of disruptions and/or total or partial unavailability, and/or interruption of all or part of the services offered on networks operated by Third-Party Operators.

ARTICLE 5 - ADVERTISING

The Relead service is free for the visitor as a customer of the site equipped with the Relead systems. In return, visitors agree to receive any advertising messages, sales, promotions, quizzes, games or any other commercial messages. As a user of the Service you acknowledge and agree that Relead may serve third-party advertisements before each connection to its Wi-Fi network.

ARTICLE 6 - SUSPENSION OR TERMINATION

The “Service”, at the request of third parties and/or any competent authority, reserves the right to suspend the Wi-Fi service temporarily or permanently without its liability being able to be sought and without the user being able to claim any compensation or reparation.

ARTICLE 7 - ACCEPTANCE

Registering for the “Service” Internet service in order to obtain an access code constitutes acceptance of these rules of use.

ARTICLE 8 - DROIT APPLICABLE

These Conditions of Use are subject to Tunisian law. The validity and/or execution of these Conditions of Use will be submitted to the competent Courts of Sousse.
